来源:KEMENPAR · Antara Indonesia

Compliance Checklist

  • Verify whether your museum digital asset project has executed a tripartite IP agreement with Indonesia’s Ministry of Culture and BRIN before commercialization.
  • Submit concurrent permit applications to both the Ministry of Forestry and Ministry of Culture for any project located within designated forest-cultural zones (e.g., Mount Bromo, Ubud buffer areas).
  • Initiate pre-filing consultation with DKI Jakarta’s Dinas Kebudayaan before launching physical or digital cultural infrastructure projects in Jakarta.

English Summary

Indonesia's Ministry of Culture signed five cross-sector cooperation agreements with the Ministry of Communication and Digital Affairs, Ministry of Forestry, Ministry of Creative Economy, BRIN (National Research and Innovation Agency), and Jakarta Provincial Government. Though not a tax regulation per se, these agreements establish binding inter-agency frameworks affecting compliance for foreign businesses operating in cultural heritage, digital museums, creative IP licensing, and eco-cultural tourism. Key implications: 1) Foreign firms digitizing national collections must comply with joint technical standards set by Culture and Communication Ministries; 2) Commercial use of museum assets requires tripartite IP agreements with BRIN and the Culture Ministry; 3) Projects involving forest-adjacent cultural sites need concurrent permits from Forestry and Culture Ministries. No explicit deadlines are stated, but implementation is effective immediately per Ministerial statement. Businesses must conduct inter-ministerial due diligence before project launch — especially critical for investors in digital platforms, NFT-based cultural assets, and provincial-level cultural infrastructure PPPs.
