Compliance Checklist

  • Audit your EU-origin imports into Indonesia for exposure to potential retaliatory tariffs—prioritize HS codes under Chapters 84, 29, and 21
  • Engage BKPM and Indonesia’s Ministry of Trade to track DSB authorization timelines and request advance notice of concession suspension scope
  • Join GAPKI/APROBI-led industry consultations to influence proportionality and sectoral targeting of any authorized suspension

English Summary

Indonesia has formally requested the WTO Dispute Settlement Body (DSB) to authorize the suspension of concessions and other obligations toward the European Union, citing the EU’s failure to comply with WTO Panel rulings in dispute DS593 on palm oil. This action is grounded in Article 22.2 of the WTO Dispute Settlement Understanding. The suspension will initially target goods but may extend to services or intellectual property. Indonesia must quantify its annual trade losses accurately to ensure the level of suspension remains within WTO-authorized limits. Affected parties include EU exporters to Indonesia—particularly in machinery, chemicals, processed foods, and biofuel-related equipment—as well as global palm oil supply chain actors. While no immediate tariffs have been imposed, foreign businesses must monitor DSB authorization outcomes and potential Indonesian implementing regulations expected within 6–12 months. Proactive engagement with BKPM and the Ministry of Trade is advised for market access planning.

Jakarta (ANTARA) - The Indonesian government has requested that the World Trade Organization's Dispute Settlement Body (DSB) suspend concessions and other obligations to the European Union (EU) following the EU's failure to fulfill its obligations regarding palm oil. Trade Minister Budi Santoso said in Jakarta on Saturday that the measure was taken after the EU failed to meet deadlines to adjust its policies or fully comply with the WTO panel’s rulings and recommendations in the palm oil dispute (DS593). “The suspension of concessions will focus on the goods sector, but is open to other sectors. We will ensure that the amount of damage is calculated carefully and that the case is handled effectively while simultaneously maintaining bilateral relations with the EU,” Santoso said. He said the suspension of concessions was necessary and consistent with Article 22.2 of the WTO dispute settlement rules, following the EU's failure to revise its palm oil policies in line with the panel's rulings and recommendations. Furthermore, the EU was unable to provide equitable compensation to Indonesia for its failure to fulfill its WTO obligations. "Indonesia can apply for concession suspension authority to the DSB to safeguard Indonesia's rights in the future should the EU fail to comply with the WTO Panel ruling," Santoso said. He added that the Indonesian government's steps have been coordinated across government agencies and received support from businesses, including the Indonesian Palm Oil Producers Association (GAPKI) and the Indonesian Biofuel Producers Association (APROBI). According to him, Indonesian businesses' calculated annual losses are enormous due to the loss of potential export value.
